Medicare Compliance Program
The Patient Protection Act that was signed into law in March 2010 mandates that ALL Medicare (and other government providers) have a compliance program as a condition of enrollment.
This is expected to be mandatory within the next year. Providers who do not have a compliance program will be in violation of their enrollment agreement with Medicare.
According to Medicare, anywhere from 86%-94% of all Medicare claims are not documented correctly. The purpose of the Medicare Compliance Program is to create a system of checks and balances to help DETECT, CORRECT and PREVENT errors in coding and documentation.
The Medicare Compliance Program contains a 7-step protocol per the recommendation of the Department of Health and Human Services. The program includes a Standards and Procedures Manual that is already pre-written specifically for Doctors of Chiropractic.
The program shows also takes you step by step on how to 1) audit and monitor patient files, 2) designate a compliance officer, 3) conduct continued education on coding and compliance issues, 4) responding in writing to any detected offenses, 5) how to keep an open door policy with your staff and 6) enforcing disciplinary standards.

Managing Medicare in Chiropractic
In 2005, the Department of Health and Human Services stated that 94% of all chiropractic claims were not properly documented. They also found that 67% of all chiropractic claims were for treatment that was not covered or not medically necessary. As a result, Medicare has hired Recovery Audit Contractors (RAC’s) to perform post-payment audits on your Medicare claims for the past three years. The reason for these statistics is largely because chiropractors are unaware of the specific documentation requirements by Medicare.
Medicare auditors have a zero tolerance policy for improperly documented claims. If you only collect only $2,500 per month from Medicare, that equals $30,000 per year or $120,000 over four years…the amount of time that Medicare can audit patient files.
